Qquench Media is a business that provides its customers with services in Branding, Web, UI UX Design and Development, Marketing, eLearning, and Development.

(“Company”), a company incorporated in India, and you, or the legal entity you represent, as a customer (“Customer”). 

General

These terms and conditions (‘Terms’) set out the rights, obligations and restrictions that apply between the Customer and the Company when the Customer purchases the Company’s services and accesses the Company’s website and platform at www.qquench.com/www.qquench.ai  (“Platform”) and/or accesses, uses or downloads any of the data and services provided by the Company.

The Customer must:

Be 18 or older, or be 13+ with parental or guardian consent 

Have the legal capacity to enter into a binding contract

Submit only accurate and updated information to the Company  

These Terms apply to all services offered by Qquench Media, including but not limited to UI/UX Design, Branding, eLearning Solutions, Website & App Development, AI-powered Automation, and Performance Analytics. 

Formation of Contract

The Company offers services such as brand strategy, identity design, redesign, redrawing, website design, and app design based on drafts provided by the Customer.

The Customer initiates by submitting a project brief via the “Start a Project” form. The Company will respond with a quote—this is only an invitation to offer, not a binding agreement. Once the Customer accepts the quote, a formal contract is formed upon the Company’s written confirmation. 

The Customer agrees to pay an advance amount as specified before project initiation. The remaining amount is payable upon delivery. 

Services and Delivery

Services are delivered digitally, typically in formats like .PDF, .PSD, .XD, Articulate Storyline 360, Rise, or as agreed with the Customer.

The Customer is entitled to: 

• Two free rounds of revisions 
• All revision requests must be made within 10 business days of delivery 
• Further revisions are billable, with prior pricing confirmation 

Revisions do not include the introduction of new ideas or changes to the original brief. 

If no approval or feedback is received after three follow-ups, the project will be deemed approved and charged accordingly. 

Payment

Payments are due per project delivery milestone or as defined in the agreement. 

Late payments may attract a fee of 2% per month or the maximum interest allowed by law.

An invoice is raised at the time of final approval or automatic approval (as outlined above). 

Refunds and Cancellation

(a) Refund after Initial Responses:
If not satisfied with the first drafts, the Customer may request a refund within 3 business days. A 20% service fee will be deducted. 

(b) Refund before Order Initiation:
A cancellation email must be sent within 12 hours of placing the order. Full refunds will be issued in that case. 

Refunds are not available for: 

• Website design 
• App design 
• Book covers 
• Product packaging 
• eLearning services 

Once revisions begin, the refund option becomes void. Refunds are applicable only to the original client and not to intermediaries. 

Turnaround Time (TAT)

Customers must respond within 30 days of each delivery. Failure to do so marks the project as completed. 

Qquench Media works 8:00 AM to 5:00 PM IST, Monday to Friday.
Closed on weekends and Indian public holidays. TAT is calculated based on business hours only. 

Usage Policy

The Company may restrict access to Services as required.

The Customer may: 

• Reproduce, publish, license, distribute or display final deliverables after full payment 

The Company retains the right to showcase the final work in its portfolio unless otherwise requested in writing. 

Availability of Services

The Platform may undergo downtime for maintenance or updates. New services may be in beta or testing stage, and may not have full functionality during that time. 

Legal Protection and Waiver of Liability 

Services are delivered on an “as-is” basis, under the defined scope in the proposal. 

Qquench Media disclaims all express or implied warranties, and shall not be held liable for: 

• Business loss
• Data breaches
• Interruptions 
• Faulty performance due to third-party tools

The Customer agrees to indemnify Qquench Media from any third-party claims, damages, or liabilities.

Termination of Contract

Terms remain valid until formally terminated by either party via written notice. Project-specific terms will be detailed in individual proposals. 

Trademarks and Amendment

All trademarks, logos, and designs remain the property of Qquench Media or respective owners. 

We reserve the right to amend these Terms at any time, with updates reflected on the website or in project agreements. 

Dispute Resolution

These Terms are governed by Indian law.
Disputes are subject to the jurisdiction of Pune, Maharashtra.
